1. Scope and acceptance
These Terms govern access to and use of the website operated by Kyma Charter ("Provider"), including informational content, enquiry forms and online booking flows related to boat tours, rentals and associated events.
By browsing the site, submitting forms or confirming a service request, you confirm that you have read these Terms and our Privacy Policy and — where required — that you consent as indicated.
The economic and operational conditions of each service (duration, boarding point, maximum guests, deposits, applicable cancellation rules) are those shown on the service page, in the pre-contractual summary and in the confirmation sent after payment, unless otherwise agreed in writing.
2. Eligibility
Services are aimed at individuals and legal entities acting for their own purposes. You warrant that the information provided is accurate, up to date and that you have legitimate authority to represent any third parties named.
3. Role of the website and contract formation
The site primarily showcases services and provides technical intermediation for collecting requests and — where applicable — concluding recreational boating contracts in compliance with applicable laws.
Unless stated otherwise in the checkout flow, a contract is deemed concluded when payment is successfully processed by the payment provider and Kyma Charter records the booking as confirmed, subject to weather and maritime safety rules that may require rescheduling or cancellation according to published policies.
4. User obligations
You must not use the site unlawfully, interfere with IT systems, distribute malware or systematically scrape data without authorisation.
You agree to arrive on time for boarding, carry valid identification where requested and follow skipper/crew and maritime authority instructions.
5. Payments
Card payments are processed via Stripe Technology Europe Ltd (or affiliates) under Stripe's terms.
Kyma Charter does not store full card numbers on its own systems; payment data are handled by the payment processors as described in the Privacy Policy.
6. Changes and availability
The Provider aims to keep the site available but does not guarantee uninterrupted access due to maintenance, force majeure or third-party outages.
Itineraries may change for technical, weather or regulatory reasons; alternatives will be communicated where reasonable.
7. Intellectual property
Branding, copy, images, video and layout are owned by the Provider or licensed. Commercial reproduction without written consent is prohibited.
8. Limitation of liability
Except where mandatory law provides otherwise (including wilful misconduct or gross negligence), Kyma Charter is not liable for indirect damages, lost profits or issues arising from third-party links.
Consumer rights under applicable consumer protection law remain unaffected.
9. Governing law and updates
Unless mandatory consumer rules dictate otherwise, these Terms are governed by Italian law. For consumers resident in Italy, the court of the consumer's place of residence or domicile may have jurisdiction where applicable.
Kyma Charter may update these Terms by publishing a new version on the site; please review this page periodically.
